When truck drivers violate the regulations, hold them accountable

Pottsville residents place a great deal of trust in one another when it comes to the general public. For instance, while defensive driving is a good idea, motorists still have a certain amount of trust they place in other drivers to follow the rules of the road. When other drivers fail to follow these rules, it can lead to deadly consequences, particularly with drivers of semi-trucks and other large vehicles.

Recently, this blog has discussed the additional rules that govern truck drivers. These rules, which are set out in the federal trucking regulations, impose restrictions on the amount of time a truck driver can be on the road before resting and the behaviors the truck driver can engage in while driving. The regulations also contain a host of rules governing the safety standards of the truck itself that must be satisfied.

When a truck driver fails to follow the federal regulations, it can result in severe injury to others on the road. Fortunately, those injured may be able to bring a personal injury action to hold the driver or the trucking company responsible.

As with other motor vehicle accidents, the task in this lawsuit is to prove that a negligent driver caused the accident. The difference with truck accidents is that the federal regulations might be used as evidence of the truck driver's negligence, where the truck driver was not following the additional rules he or she was bound to follow.

Our firm has significant experience in dealing with trucking accidents. We understand the federal trucking regulations, and how these regulations can apply to a negligence action. We examine the facts and circumstances of each case to determine whether any rules were violated, and how to best advocate for our clients to hold the negligent driver accountable.
