Navigating through the maze of medical malpractice issues

Ultimately, the admissibility of an apology is just one of many issues that may arise in a medical malpractice action. There can also be complex issues of whether the physician’s care violated the duty of care, and how that violation caused the patient harm.

For example, in a case involving a missed diagnosis, there can be questions of whether the doctor should have diagnosed the illness at the time in question, and what impact that missed diagnosis had on the patient’s health. These are fact intensive questions, and typically require expert testimony to prove these issues in court.
